The 2019 Nevada Legislative Session resulted in some new obligations for Nevada employers — paid time off, increase to minimum wage, employee misclassification, etc. This resulted in many questions about how these new laws were going to apply.
- Are you a business with 50 or more employees? You will likely be required to provide paid time off to your employees beginning January 2020.
- Does your company offer qualifying health benefits to employees and pay based on the lower tier minimum wage? You will want to make sure your plan meets the new requirements.
- What is your company policy on an employee calling in sick or notifying you that they are injured and cannot work? You will want to make sure it is compliant with AB181.
Additionally, recent changes to the salary threshold to exempt certain employees from the minimum wage and overtime requirements of the Fair Labor Standards Act (FLSA) has many employers analyzing their current salary data and determining the best course of action. Do you raise employees’ salaries to maintain exempt status (assuming all other requirements are met)? Do you reclassify as non-exempt and pay overtime when overtime is worked?
