In a few days, the Form I-9, which is used for verifying new hires’ employment eligibility, will be expiring.  What should you do?

The current Form I-9 was released on July 17, 2017, with a stated expiration date of August 31, 2019.  On March 1, 2019, the U.S. Citizenship and Immigration Services (“USCIS”) published a Federal Register notice to invite public comments on the proposed extension of Form I-9 without any changes.  On June 5, USCIS published another Federal Register notice to invite further comments.  The public commenting period closed on July 5.

According to the USCIS I-9 website, “We will publish a new edition of this form soon.  In the meantime, you may file using the 07/17/17 edition.”  In an email that went out this morning, USCIS reiterated that employers should continue to use the current Form I-9, even after the August 31st expiration date, until a new version becomes available. USCIS has not yet announced whether the new version will reflect changes based on the comments it received or it will simply change the expiration date.

Although we do not have a new form yet, as soon as a new Form I-9 is released Nevada Association of Employers will let you know and have it available to you.
