In early September, President Biden announced that private sector employers with 100 or more employees must require all employees be either fully vaccinated or tested weekly for COVID-19. This new requirement raised a lot of questions for employers, including:

  • How are they defining “100 or more employees”?
  • Who will pay for COVID testing?
  • When will this requirement go into effect?
  • Is this mandate legal?
  • How will it be enforced?
